In the Netherlands, the energy savings obligation is seen as an important tool to promote energy efficiency and reduce greenhouse gas emissions. In 2024, this topic is more prominent than ever on the agenda, with new laws and regulations urging companies and institutions to take action. In this blog, we look at what the 2024 energy savings obligation means and what it means for you and your organization.
What is the energy savings obligation?
As an entrepreneur, do you have a consumption of 50,000 kWh or 25,000 m3 or more? Then you are obliged under the Environmental Management Act to take energy-saving measures, with a payback period of up to 5 years. We call this the energy-saving obligation. In addition to these energy-saving measures, you are also obliged to implement CO2-reducing measures.
Once every 4 years you must report on the measures you have taken as an organization. You do this via the information obligation energy savings or via the research obligation energy savings. For some companies, the European Energy Efficiency Directive (EED) also imposes a reporting obligation, the EED audit obligation.
No later than December 1, 2023, you had to submit these reports through My RVO. Have you not done this? Then we recommend doing so as soon as possible!
Information Obligation
When you must comply with the Energy Savings Obligation, you must also comply with the Information Obligation. The Information Obligation requires large companies and institutions to report annually on their energy-saving measures and results. It promotes transparency and encourages active involvement in energy conservation.
EED audit requirement
The EED audit requirement requires large companies to conduct an energy audit every four years to identify their energy consumption and savings opportunities. It helps promote energy efficiency and achieve savings.
Recognized Energy Conservation Measures List (EML).
The Rijksdienst voor Ondernemend Nederland (RVO) has published a list of recognized measures. To comply with the energy saving obligation, you must implement all the measures on this list – the Recognized Energy Saving Measures List (EML).
What is new in 2024?
By 2024, a number of important developments have taken place. One is an increasing focus on compliance and enforcement of energy savings obligations. The government is going to enforce the obligations more strictly. Companies that fail to comply can expect fines.
In addition, new measures have been implemented to encourage energy savings. These include subsidies and financing opportunities for companies investing in energy-saving measures. These include improving insulation, replacing outdated equipment, and implementing energy-efficient technologies.
